On the other hand, inevitable Discovery was applied in the State Vs. Garner case, where Garner was arrested for murder, and officers obtained a warrant, searched his house and found the alleged murder weapon. Upon trial, it was found that the search warrant did not meet the probable course; thus, the evidence was not admissible in the court. The court applied the inevitable discovery exception, and the evidence was used against the defender (Farb, 2017). The move by the court to use the evidence, even when the warrant did not meet the probable course, was a correct call as the defendant was, in the end, found guilty.
