These are employment qualifications that employers consider when making decisions about hiring and retaining employees. This rule only permits hiring persons based on race, national origin, and age only if the characteristics are considered bona fide occupational qualifications (EEOC, 2018). This is a defense of Title VII of the Civil Rights Act of 1964.
- Access Discrimination vs. Treatment Discrimination
Access discrimination takes place where occupational opportunities are withheld from individuals when and access to jobs denied. In contrast, treatment discrimination occurs where individuals are employed. Still, they are treated differently once they begin work, for example, receiving fewer resources than they should be based on their job criteria (EEOC, 2018). Both access and treatment discrimination are forms of employment discrimination.
